Citation: On wednesday 02/23/2012 at approximately 0730 while performing a scheduled SPS procedure code at establishment 09715 the following non-food contact surface non-compliances were observed. No product was involved. The steel rails and brackets of the overhead garage door in the processing room are starting to rust. No signs of rust particles were observed on any tables or processing equipment. The large hinge pins on the carcass primal cooler door are rusted as well. The steel man door that is located beside the mentioned garage door in the processing room has a gap on the bottom right side approximately 2"x2" and smaller that is creating an outside opening. The hole could lead to vermin and insects to enter the establishment. Mr. [redacted] was immediately notified of the non-compliance. This is a non-compliance of 9 CFR 416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated. 416.2(b)(3) Walls, floors, ceilings, doors,windows and other outside openings must be constructed and maintained to prevent the entrance of vermin, such as files, rats, and mice. This document serves as written notification that you're failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action. You are hereby advised of you're rights to appeal this decision as delineated by 306.5 and/or 381.35 of 9CFR.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(3) Walls, floors, ceilings, doors, windows, and other outside openings must be constructed and maintained to prevent the entrance of vermin, such as flies, rats, and mice.
