Violation: 416.13(c), 416.2(a), 416.4(a), 416.4(b)

Citation: At approximately 0559 hours, after the establishment completed their preoperational inspection, I proceeded to perform scheduled procedure 01B02. The following was observed during my observation in the Processing Area: On the Band Saw equipment- there was a 1/2" x 1/2" area found with meat particles, fat and other product residues, near the saw blade exit. The Grinder held two pieces of meat attached to the inside grinding equipment, toward the front and dried and crusted product residues also was found at this location. [redacted] was present during these findings and immediately took corrective actions on said equipment. As my inspection continued; in the same area, I found a smoke house rack that held approximately 7 pieces of meat that ranged in sizes up to 1/2" in size and on various locations on the inside and outside of this equipment. I asked the monitor was this a clean rack and he answered that it was. I then showed both [redacted] and [redacted] these findings. Corrective actions were not immediately taken; therefore U.S. reject tag # B 36279169 was applied to this piece of equipment. While attempting to place this tag a fly was observed landing on several areas of this same equipment. I then showed the floor supervisor [redacted] the insect; while it was on the equipment. The insect was killed and I showed [redacted] The establishments preoperational records showed each of these equipments to be acceptable and marked with a check mark. Shortly after I asked was the rack a bacon rack. It was said that the rack in question was used for bacon and other products as well. I then reviewed the establishments SSOP Plan. In their plan ( Part III), section A- [redacted] ) , under 2a. They state,"[redacted] l.[redacted] was verbally notified of this noncompliance for all preoperation findings and [redacted] of the rack finding. After the start of production; approximately 0645 hours, I observed additional noncompliance. In the processing area, near the sink side of the room, there was a small pallet which held enclosed bags of brown sugar and closed lugs of another ingredient. During an observation of this pallet, I observed 3 flies flying around and landing on the bags. I stopped [redacted] from his processing of Ground Meat on the other side of the room and asked him to come over to my findings. The insects were killed and removed immediately and other corrective actions were taken. The establishment has failed to comply with the regulatory requirements listed under 9 CFR 416.13(c), 416.2(a) 416.4(a) and (b).


416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOPís.

416.2(a) Grounds and pest control. The grounds about an establishment must be maintained to prevent conditions that could lead to insanitary conditions, adulteration of product, or interfere with inspection by FSIS program employees. Establishments must have in place a pest management program to prevent the harborage and breeding of pests on the grounds and within establishment facilities. Pest control substances used must be safe and effective under the conditions of use and not be applied or stored in a manner that will result in the adulteration of product or the creation of insanitary conditions.

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
