Citation: On 1/12/2012 while performing export certification for product intended for export to Chile the following labeling noncompliance was observed: Out of the 54 cases of product code 97124 USDA CHOICE 1855 Black Angus Bnls Beef Ribeye Lip-On 2X2, 23 cases which were produced on 1/9/2012 were incorrectly identified with a label marked Bnls Beef Outside Skirt (Diaphragm Meat). Also, the 60 cases of product code 24470 USDA Choice Bnls Beef Outside Skirt (Diaphragm Meat) are labeled as PIECES PER CASE 8 Packages (each one holding 4 pieces). When verifying declared case count as labeled, cartons contained only 7 packages each. Mr. and Mr. were notified verbally and in writing with this NONCOMPLIANCE RECORD of the establishment’s failure to comply with the Export Requirements for Chile dated December 29, 2011 as well as the requirements of sections 317.2(c) and 317.8 of the Meat and Poultry Inspection Regulations.


317.2(c) Labels of all products shall show the following information on the principal display panel (except as otherwise permitted in this part), in accordance with the requirements of this part or, if applicable, part 319 of this subchapter:

317.8(a) No product or any of its wrappers, packaging, or other containers shall bear any false or misleading marking, label, or other labeling and no statement, word, picture, design, or device which conveys any false impression or gives any false indication of origin or quality or is otherwise false or misleading shall appear in any marking or other labeling. No product shall be wholly or partly enclosed in any wrapper, packaging, or other container that is so made, formed, or filled as to be misleading.
