Citation: On 05/15/2012 at approximately 0515 hours, while performing a SPS ( Sanitation Performance Standard ) verification activities, I observed the following noncompliance in the shipping area. Specifically, I observed a refrigeration truck/trailer backed into bay 14. The trailer # is 4463.There was no product on the trailer and that JBS employees had not made any attempt to clean the trailer.Upon entering the trailer, I observed that the floor of the trailer was littered with broken wood fragments, measuring up to 2 feet in greatest linear dimension, derived from broken wooden pallets. Upon further inspection, I noted that the channeled floor was also notable for a heavy accumulation of congealed blood, putrefied fat scraps, decomposing meat fragments, a sundry of paper and plastic fragments, as well as black grease and oil, derived from the motor of the refrigeration unit, thus creating a insanitary condition. I immediately imposed regulatory control and placed a US RETAINED Tag  ( # B39 034532 ) on the back entrance to the trailer. The trailer was rejected for further use.[newline][newline]I notified QA employee  of the aforementioned noncompliance, as well as the establishment's failure to comply with the regulatory requirements prescribed in 9 CFR 416.4(d) " Product must be protected from adulteration during processing, handling, storage, loading, and unloading and during transportation from official establishments". Mr. ( Food Safety Supervisor ), was also notified of the noncompliance. No direct product contamination was observed.[newline][newline]This document serves as a written notification that your failure to comply with the regulatory requirements could result in additional regulatory or administrative action.

Regulation:

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
