Citation: On 17 August 2010, at approximately 1315 hrs, whilst performing a scheduled ISP procedure code 03H02, a review of the 'Chilling Record', also known as 'USA-HACCP-FORM-009' was performed and the following noncompliances were identified: Entries dated 8-16-10, for Kettle # 1, Kettle # 2, and Kettle # 3 contain values of 60, 60, and 59 degrees Fahrenheit, respectively, in the columns headed with "TEMP (F)" and the rows prefaced with "120 F TO 55 F WITH(IN) 6 HOURS". These entries were initialed by both of the QC personnel, [redacted] (RP) and [redacted] (JG). A preshipment review was noted as having been performed on 17 August 2010, at 11:55 am; these entries were signed by [redacted] Upon identification of this initial noncompliance, a thorough review of USA-HACCP-FORM-009 was performed, and no additional deficiencies were identified. Upon identification of the noncompliance, regulatory control action was taken by tagging a pallet of pork blood, this pallet containing twenty-six (26) five-gallon buckets of blood, with US Rejected/US Retained tag number B39443955. [redacted] Jr, was notified of the noncompliance by approximately 1330 hrs. The establishment is not in compliance with the following regulations: 9 CFR 417.5(a)(3), which states: "The establishment shall maintain the following records documenting the establishment's HACCP plan: Records documenting the monitoring of CCP's and their critical limits, including the recording of actual times, temperatures, or other quantifiable values, as prescribed in the establishment's HACCP plan; the calibration of process-monitoring instruments; corrective actions, including all actions taken in response to a deviation; verification procedures and results; product code(s), product name or identity, or slaughter production lot. Each of these records shall include the date the record was made."; 9 CFR 417.5(c), which states: "Prior to shipping the product, the establishment shall review the records associated with the production of that product, documented in accordance with this section, to ensure completeness, including the determination that all critical limits were met and, if appropriate, corrective actions were taken, including the proper disposition of product..."

Regulation:

417.5(a)(3) Records documenting the monitoring of CCP’s and their critical limits, including the recording of actual times, temperatures, or other quantifiable values, as prescribed in the establishment’s HACCP plan; the calibration of process-monitoring instruments; corrective actions, including all actions taken in response to a deviation; verification procedures and results; product code(s), product name or identity, or slaughter production lot. Each of these records shall include the date the record was made.

417.5(c) Prior to shipping product, the establishment shall review the records associated with the production of that product, documented in accordance with this section, to ensure completeness, including the determination that all critical limits were met and, if appropriate, corrective actions were taken, including the proper disposition of product. Where practicable, this review shall be conducted, dated, and signed by an individual who did not produce the record(s), preferably by someone trained in accordance with § 417.7 of this part, or the responsible establishment official.
