Citation: ***HATS CATEGORY III--WATER AVAILABILITY*** On 14 October 2010, at approximately 0838 hrs, whilst performing an unscheduled ISP procedure code 04C02, I elected to perform a Humane Activity Tracking (HAT) verification of water availability in the pen labeled "Import 7" and I noted the following noncompliance: There were approximately 40 market and roaster swine contained within this pen that varied in size from 5 to 25 kg in size. The pen contains several nipples along the top of an approximately 1 metre high concrete wall; the water supply to these nipples was on at the time of the noncompliance. However, it was noted that the small roasters within this pen lacked sufficient heighth to reach these nipples and, therefore, lacked access to water. I took immediate regulatory control action and placed US Rejected/US Retained tag number B39443958 on the top of the concrete wall to the left side of this pen. [redacted] Jr., was notified of the noncompliance at approximately 0840 hrs. He turned on taps such that a steady flow of water flowed into the pen and provided water to all swine within this pen. I reviewed Mr [redacted] actions, deemed them to be satisfactory, and removed the tag at approximately 0841 hrs. The establishment is not in compliance with the following regulation: 9 CFR 313.2(e), which states, in part, the following: "Animals shall have access to water in all holding pens and, if held longer than 24 hours, access to feed...". This noncompliance is linked to a noncompliance of similar cause, noncompliance number 46-2010-13030, dated 24 August 2010.

Regulation:

313.2(e) Animals shall have access to water in all holding pens and, if held longer than 24 hours, access to feed. There shall be sufficient room in the holding pen for animals held overnight to lie down.
