Citation: On 1/4/11 at approximately 0700 , at the start of operations Dr. and I observed the non penetrating pneumatic stun gun operator attempt to stun a calf. The stun gun fired without completely discharging the non penetrating concussion bolt and did not render the calf unconscious . An immediate second stunning attempt rendered the calf unconscious. Dr. and I continued to observe the stunning of 2 more calves where the first attempt did not completely discharge the concussion bolt and the immediate second attempt rendered the calf unconscious. At that time Dr. and I stopped operations and took a regulatory control action by applying U.S.Retained tag #B38685293 to the pneumatic (non penetrating) stun gun. IPP immediately contacted DO and notified Management . The animals in question did not appear to be in pain as a result of the non penetrating stun gun's misfires. This did not appear to be a deliberate act of applying pain to the animals. This is a deviation of plants stunning procedures and a non compliance with Meat and poultry regulations 9CFR313.50(c) and 313.15. Failure to control this type of non compliance could result in further regulatory and or administrative control measures .

Regulation:

313.15(a)(1) The captive bolt stunners shall be applied to the livestock in accordance with this section so as to produce immediate unconsciousness in the animals before they are shackled, hoisted, thrown, cast, or cut. The animals shall be stunned in such a manner that they will be rendered unconscious with a minimum of excitement and discomfort.
