Citation: At approximately 1105 hours on Monday 07/19/2010, while performing a scheduled 06D01 task I found the following deficiencies: 1) Rust on the three light fixtures on the slaughter floor. The two lights on the ceiling over the door between the rail scale and wall rust on the sides of the fixtures and the ceiling light between the rail scale and the splitting saw with rust on the sides of the fixture. 2) Rust on the frame and door of the knocking pen. This is in violation of 9CFR 416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated. 9CFR 416.3(a) Equipment and utensils used for processing or otherwise handling edible product or ingredients must be of such material and construction to facilitate thorough cleaning and to ensure that their use will not cause the adulteration of product during processing, handling, or storage. Equipment and utensils must be maintained in sanitary condition so as not to adulterate product. 9CFR 416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product. Pre-operational records were checked and no deficiencies were recorded. general manager and Andy Pudliner, owner were notified of this noncompliance. No product was involved in this noncompliance. No similar NRs were found in the past 60 days. You are hereby advised of your right to appeal this decision delineated by 305.5 and/or 381.35 of CFR. This document serves as a written notification of your failure to comply with regulatory requirements could result in additional regulatory or administrative action.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.
