Citation: *** HATS CATEGORY III: WATER AVAILABILITY*** On 14 December 2010, at approximately 0753 hrs, whilst performing an unscheduled ISP procedure code 04C02, I elected to perform various Humane Activity Tracking tasks and, during my verification of water availability at this establishment, I observed the following noncompliance: The establishment has automatic waterers which are suspended from the ceiling in the pens; at the time of my observation, there were four market swine in one area that did have water, but a fifth market swine was gated off from the other four market swine and this fifth market swine lacked access to the area in which the other four were contained; additionally, the area in which this market swine was contained lacked water because the automatic waterer was contained within a bracket on the wall that is located approximately seven feet from the ground. Mr Dennis Hartman, the owner of the establishment, was notified of the noncompliance immediately; no regulatory control action was taken because Mr Hartman removed the automatic waterer from this aforementioned bracket, thereby causing the pig to have access to water. I was satisfied with Mr Hartman's response to this noncompliance. The establishment is not in compliance with the following regulation: 9 CFR 313.2(e), which states the following: "Animals shall have access to water in all holding pens and, if held longer than 24 hours, access to feed. There shall be sufficient room in the holding pen for animals held overnight to lie down."
