Citation: On September 21, 2010 at 08:30, I performed ISP procedure code 03G02, Fully cooked Not Shelf Stable, Spiral sliced Ham, lot ID S52S-07203, oven Product # 7203, 415 9/7.process start date 9/21/2010. Product is packed in RTE Room #2215. To perform this procedure, I reviewed all the HACCP records, associated with this product. Specially, I verified that monitoring of all critical control points was performed at the specified frequency. The critical limits were met, all the verification activities were completed including; all testing, record reviews, direct observation, equipment calibration, and pre-shipment review signed as outlined in the establishment's Fully Cooked Not Shelf Stable Plan dated 01/12/2010 .While reviewing Listeria Testing programs, for RTE room # 2215, I observed the following noncompliance: Band saw # 37056 slide table top and top of the table #37056 were both positive for product contact on 8/27. Stuffing horn was positive. for Listeria species. Corrective action was taken according to the Listeria testing program. The product was produced under alternative 2, plant use antimicrobial agent. Plant also used "Compliance guidelines to control Listeria Monocytogenes in post -lethality Exposed Ready - To- Eat meat and Poultry products" as supporting documentation. Supporting documentation states on page 40 under 5. [redacted]. Following Product retained: Spiro Hams on hold produced in room 2215. Production date 8/27/10, product # 7203, cases of product 26, wt. 980 lbs, 9/7/10, product # 7203, cases#, 140, wt. 5407.5 lbs, 9/8/10 product #7203, cases # 108 wt. 4078.9 lbs, 9/9/10, product # 7203, cases 93,wt 3593 lbs. Total 14,060.00 lbs. USDA retained tag # 24762101, B24762108, B 24762107, B 24762062, B24762121, B 24762110, B24762122,B 24762113,B24762119B24762125, B24762115,B24762102B24762114B24762120,B24762106.This product was produced while product contact Listeria environmental sampling occurred. The product was held until result obtained. The product contact was positive for Listeria species. Subsequently product testing for Listeria species was positive. Plant Listeria program states on page 7 of 18: "[redacted]." The plant's testing of the product for L.spp is contrary to the plant Listeria program, and the supporting documentation compliance guidelines to control Listeria Monocytogenes in post Lethality Exposed Ready to Eat Meat and poultry product, which the plant uses as Supporting Documentation. The plant does not provide supporting documentation for testing for Listeria spp. on the product. Plant refuse to test for Lm according to plnt"s Listeria program. Ms. Manager of Technical Service and Dr. Food Safety Superintendent, was notified ,verbally and writing of this noncompliance to comply with regulatory requirements of 9 CFR part 430.4(b)(1) and 417.5(a).

430.4(b)(2) Alternative 2. Use of either a postlethality treatment (which may be an antimicrobial agent) that reduces or eliminates microorganisms on the product or an antimicrobial agent or process that suppresses or limits growth of L. monocytogenes. If an establishment chooses this alternative
