Violation: 416.13(c), 416.4(d)

Citation: On February 6, 2012, at 15:30, I was performing export duties in order assembly dock observed the following noncompliance. I observed two cardboard combos containing boneless ham bottom; lot of blood around two combos, already stamped and ready for export. I further investigate by lifting of the combos by employee who is performing export duties and found there was blood dripping around wooden pallet the blood is coming from the two combs. Up on further investigation the rest of the combos, I did not observed any blood around the combs and none exhibits blood around and pallets. Regulatory control action was initiated in accordance with 9 CFR 500.2 by applying U.S. Retain Tag NO B24761529 and B24761528 on two combos. The two combs were reconditioned in presence of inspector also it was observed that original combs basted and hole inside plastics exposed product wooden pallets. Mr. Supervisor of order assembly was verbally notified of the noncompliance, of the retention of the combo of bacon ends and pieces log, of the failure to meet the Meat and Poultry Regulations This is in violation of Regulations 9 CFR 416.1 because of insanitary conditions to ensure that product is not adulterated, 416.4(d) for not protecting product from adulteration during processing, and 416.13(c) for the establishments failure to adequately monitor the implementation of the sanitation Sop. This same issue was documented on 1/27/2012, in non compliance report # MXL4704015327N / 1. Corrective actions for the non compliance included; "The team members responsible for loading product trailers attend a retraining season on monitoring combs prior to shipment. Out going load will be verfied for 3 days."Previous corrective actions and preventative measures have either been ineffective or have not been implemented to prevent recurrence. This non compliance report is being linked to NR MXL4704015327N/ 1. This document serves as written notification that your failure to comply could result in additional regulatory and or administrative actions.


416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
