Citation: At approximately 0655 hr, after plant's pre-operational sanitation and prior to the start of operations, while performing O1B02, I observed in the cut - up department two stacks of gray lugs (59) and white and gray lids (49), had pieces of fat and black specks on different areas of the lugs and lids. I took regulatory control action by applying USDA retain/reject tag # B24103804 to the area. I informed Ms. [redacted] Q.C. of the non - compliance, After sanitary conditions was restored regulatory control action was relinquished. The plant is not meeting 9 CFR 416.3(a) and 416.13 (c). Past Similar NRs - Previous Ineffective Plant Actions: Plant's further plan was either ineffective or was not implemented NR: 5-2011 dated 1/11/2011 This document serves as a written notification that your failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action.


416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOPís.

416.3(a) Equipment and utensils used for processing or otherwise handling edible product or ingredients must be of such material and construction to facilitate thorough cleaning and to ensure that their use will not cause the adulteration of product during processing, handling, or storage. Equipment and utensils must be maintained in sanitary condition so as not to adulterate product.
