Citation: At approximately 1000 hours while observing the unloading of the chickens from the truck, I noticed the water hose going into the tank near the trucks. I followed the hose up to the water holding tank behind the crate washing room. The hose was being fed into the tank through the manhole cover at the top of the tank. This cover is on a hinge at one side and had been opened to allow the hose to go into the tank. This left about a 1.5 inch gap between the lid and the top of the tank which provided direct entry into the tank holding water used directly on product. I observed that the inside surface of the lid appeared to be rusting and flaking. I then went to inform the plant manager, Mr. [redacted] who followed me out to the tank. We opened the lid and observed rust colored flaking, peeling paint on the inside surface of the lid. The lid of the tank rests on a manhole entry way that extends about 4 inches from the surface of the rest of the tank. This area had white flaking paint on the inside surface of the tank. These areas do not come into direct contact with the water. There were no visible flakes of paint in the water. Mr. [redacted] was shown the non-compliance. The establishment is not complying with 9 CFR 416.1 and 416.4(b).

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
