Citation: While performing pre-operational sanitation, which was performed after the plants pre-operational sanitation but prior to the start of the operations, on 08/11/2010, I observed the following non-compliances: At approximately 0325 hours I observed the Maestro machine to have a white waxy buildup on it. The white waxy buildup came off when scraping the residue with my nails. At approximately 0325 I applied USDA Reject tag #B37853349 to the Maestro. The maestro was recleaned, resanitized, reinspected and then released the maestro for my re-inspection at approximately 0430 hours. Past Similar NRs - NR#0007-2010-10608 dated on 03/28/2010-Previous Ineffective Plant Actions: Past preventive measures were either not implemented or were not effective in preventing recurrence. This is a failure to meet the regulatory requirements of 9 CFR 416.5(a), which states ) Each official establishment shall take appropriate corrective action(s) when either the establishment or FSIS determines that the establishment's Sanitation SOP's or the procedures specified therein, or the implementation or maintenance of the Sanitation SOP's, may have failed to prevent direct contamination or adulteration of product(s) Other items observed during pre-operational sanitation included overhead pipes and lights from the chiller across to the wall were covered with a black residue. I immediately notified Sanitation Manager, of the failure to meet the regulatory requirements of 9 CFR 416.4(b) which states ) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product. I observed 2- three hundred pound weights sitting near the wall between the turkey post chill station and turkey chiller. I immediately showed Sanitation Manager. I observed the salting tumbler to have an excessive amount of rust on the portable legs of the machine. I notified of the failure to meet the regulatory requirements of 9 CFR 416.4(b) which states ) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product. In a check of the Companies SSOP records, all areas were inspected with no deficiencies found. This document serves as written notification that your failure to meet the regulatory requirements could result in additional regulatory or administrative action.

Regulation:

416.15(a) Each official establishment shall take appropriate corrective action(s) when either the establishment or FSIS determines that the establishment’s Sanitation SOP’s or the procedures specified therein, or the implementation or maintenance of the Sanitation SOP’s, may have failed to prevent direct contamination or adulteration of product(s).

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
