Violation: 416.3(a), 416.4(b)

Citation: At approximately 0600 hours, while performing ISP 01B02 (preoperational sanitation inspection) in establishment 01015-P, prior to the start of operations but after the establishment's preoperational sanitation was completed and after the Quality Assurance technicians had released the area to FSIS on 9/5/2010. The following 06D01 (facility) deficiency was found: 1) The fan covers on the turkey and chicken motors in the picking room were rusty. This was documented on a previous Nr (noncompliance report). The number was # 34-2009-10608. The plant's further planned actions were implemented. The rusty fan covers were to be set up on a monthly check for maintenance. Also, this was to help ensure that motor covers are being checked on a regular basis and the rust on the fan covers will be minimized. I immediately notified Mr. (Sanitation Manager) of the noncompliance deficiency. This is the direct violation of 9 CFR 416.3(a), 416.4(b), as well as the plant's own SPS plan, SPS # 8. Past Similar NRs - Previous Ineffective Plant Actions: Failure to maintain the equipment in a sanitary condition. NR: 20-2010 dated 7/13/2010 This document serves as written notification that your failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action.

Regulation:

416.3(a) Equipment and utensils used for processing or otherwise handling edible product or ingredients must be of such material and construction to facilitate thorough cleaning and to ensure that their use will not cause the adulteration of product during processing, handling, or storage. Equipment and utensils must be maintained in sanitary condition so as not to adulterate product.

416.4(b) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
