Violation: 416.3(a), 416.4(a), 416.4(d)

Citation: At approximately 1230 hours, while I performed ISP 04C04 (Finished Product Standards) on chicken carcasses, I observed black specks on them, and black grease on the conveyor belts at the exit end of the chiller. The chicken carcasses were still falling onto the belt, as the carcasses exited the Cat chiller resulting in direct product contamination. I immediately notified Ms. (Linco Supervisor) and Mr. (Second Processing Supervisor) of the noncompliance. The plant took corrective actions as I remained in the area. Three gray tanks of chicken carcasses were tagged by Quality Assurance technician and 100 % reinspection will be performed on the product. Quality Assurance technician performed a post chill check at 1138 hours and it passed. This is the direct violation of 9 CFR 416.3(a), 416.4(a), 416.4(d), as well as the plant's own SSOP plan, SSOP # 2. Past Similar NRs - Previous Ineffective Plant Actions: Failure to protect product from contamination or adulteration of it. NR: 24-2010 dated 8/10/2010 This document serves as written notification that your failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action.

Regulation:

416.3(a) Equipment and utensils used for processing or otherwise handling edible product or ingredients must be of such material and construction to facilitate thorough cleaning and to ensure that their use will not cause the adulteration of product during processing, handling, or storage. Equipment and utensils must be maintained in sanitary condition so as not to adulterate product.

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
