Violation: 416.2(b), 416.2(e), 416.4(a), 416.4(b)

Citation: While performing Inspection System Procedure 01B02 (preoperational sanitation inspection) at establishment 01015-P on 12/14/2010, the following noncompliance's were found: A water/steam line directly above the fry line exiting belt was found dripping directly onto that RTE product contact surface. Ms was notified immediately of this noncompliance, and she immediately corrected this RTE surface by cleaning, sanitizing and covering the area with plastic. QA then placed a tag in this area until permanent corrective action could be taken. Also in the RTE area a conduit for the breading line was found disconnected from the electrical box with exposed wiring. This conduit was filled with what appeared to be water, creating a harborage area, or possible cross contamination. The floor drain in the rub area is not draining properly (this floor drain has been mentioned verbally to the maintenance supervisor on two different occasions). In the Raw area of the cook room, the floor drain in the tank wash room is not draining properly and water needs to be removed manually to another drain.The south wall of the tank wash room has separated and inner-wall surfaces are exposed. I notified Ms of all the above noncompliance's, the violation of 9 CFR 416.4(a), 416.4(b), 416.2(b), and 416.2(e) (2). Upon reviewing the establishment's preoperational records, there's no evidence that the establishment's sanitation personnel or Q.A. Techs have discovered these noncompliance's, nor is there written documentation of these noncompliances. This document serves as written notification that your failure to comply with regulatory requirement(s) could result in additional regulatory or administrative action.


416.2(b)(2) Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions.

416.2(e) Plumbing. Plumbing systems must be installed and maintained to:

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
