Citation: At approximately 1408 hours while performing Operational SSOP Review and Observation in the Evisceration department, I observed the on line reprocessing (OLR) cabinet not functioning properly. The Cecure spray was not being applied to the back of the chicken's lower legs and back, as one of the nozzles was clogged where chickens exit the cabinet.  I took regulatory control action by stopping the evisceration line at 1408 and informing Mr. evisceration supervisor. No USDA rejection tags were placed as I remained in the area until corrective actions were taken on the spray application. I released control of the line at about 1412. A review of the monitoring record for CCP#2 showed that the last check performed by QA was at 1330 and documented that the level of Cecure was within the critical limit and that the spray coverage was acceptable. The plants Chicken HACCP plan states in part, under monitoring for CCP #2,......  The requirements of parts 417.2(c) (3) and 417.4(a) of 9 CFR and CCP#2 of the plant's chicken HAACP plan were not met.  A similar occurrence was documented on NR ARE3809033713N/1, dated 3/13/2012.  The proposed further planned actions were either ineffective or not properly applied as demonstrated by today's regulatory and HACCP non-compliance.  Failure to implement effective corrective actions or preventative measures could result on additional regulatory and/or administrative actions.  You are hereby advised of your right to appeal this decision as delineated by 381.35 of 9 CFR.

417.2(c) The contents of the HACCP plan. The HACCP plan shall, at a minimum

417.4(a) Every establishment shall validate the HACCP plan’s adequacy in controlling the food safety hazards identified during the hazard analysis, and shall verify that the plan is being effectively implemented.
