Citation: At approximately 1130 hours, while performing a test for zero tolerance fecal check on the west evisceration line past the final wash and prior to the chiller. Performance of this check is part of procedure 03J01. I randomly selected ten poultry carcasses from the west evisceration line and inspected them for visible fecal material. While placing one of the randomly selected poultry carcass, I observed fecal material on left outside surface of the tail area on a poultry carcass on the west evisceration line. I immediately removed the contaminated carcass from the west evisceration line. I took a regulatory control action of the west evisceration line by stopping production. (First Processing Manager) was presented/informed doing my finding. The fecal material was location of the left side of the oil gland approximately 3 mm in diameter. The fecal material was light greenish in color, solid, pasty consistency. The poultry carcass was shown to Dr. (IIC). The carcass was taken to the reprocessing station for recondition. After the plants immediate corrective action according to the regulatory requirements of 417.3 was put in place, I relinquished my regulatory control action of the west evisceration line. The plant QA technician performed retests that I monitored. There were no plant employees between me and the chiller when I removed the contaminated carcass from the west evisceration line to prevent this noncompliance. This is the last point before the chill system when control can be exerted to prevent the contaminated bird from entering the chill system in violation of regulation 9 CFR 381.65 (e) as well as 9 CFR 417.2(c) (4). I then performed a 03J02 procedure for the specific lot for all CCP's plus the preshipment review. The establishment has identified fecal material to be a hazard in its hazard analysis and controls the hazard with CCP#3B. Fecal material harbors microorganisms and possible pathogens and must be prevented from entering into the chill system. The developing trend in noncompliance was discussed again in the weekly plant meeting with plant management on 06-03-2010. FSIS would expect the establishment to have procedures in place to prevent the reoccurrence of contaminated birds from entering the chill system. Continued failure to comply with regulatory requirement could result in additional enforcement action described in 9 CFR part 500. The previous preventive actions have either not been implemented or ineffective to prevent this recurrence of CCP3B of the plants HACCP Plan. NR: 54-2010 dated 6/15/2010

Regulation:

381.65(e) Poultry carcasses contaminated with visible fecal material shall be prevented from entering the chilling tank.

417.2(c)(4) List the procedures, and the frequency with which those procedures will be performed, that will be used to monitor each of the critical control points to ensure compliance with the critical limits;
