Citation: At approximately 0727 hours, while performing a 04C04 procedure code for Finished Product Standards at the Post Chill Station on the west Air Chill Line, with the ten randomly selected test carcasses. I observed one bird with fecal material on the inside of the neck cavity and wish bone area. At close examination, the fecal materials were on the right and left side of wish bone area two drops approximately 2mm in size and 1mm in size. The fecal material was on the center area of the neck cavity approximately 12mm long and 1mm wide. The fecal material was dark greenish in color with a pasty consistency. This is a failure for zero tolerance of fecal material entering the chill system in accordance with 9 CFR 417.2(c) (4). I notified (Quality Assurance) of my finding. The poultry carcass was shown to (2nd Processing Manager).The carcass was condemned by plant management, This is a failure for zero tolerance of fecal material and a failure of CCP#3 of plants HACCP plan. After the plants immediate corrective action according to the regulatory requirements of 417.3 was put in place, Quality Assurance technician performed a retest that I monitored at 0736 hours and pass. A review of the Plant Post Chill Form (Fecal 10 bird monitoring), dated 07-18-2010, shows entry at 0700 hours - accepted. I retained one tank of front halves and two tanks of whole poultry carcasses with US Retained Tag B 39 801323, B39 801703 and B 39 802467. Quality Assurance personnel retained six tanks of poultry breasts, fifty-eight of boxes (40lbs) of WOG Broilers, one combo bin of poultry backs and one combo of whole poultry carcasses with Quality Assurance Retained Tags 26758, 26744, 26716, 26747and 26766 to 26771. There was approximately 30,000 pound of product involved with this noncompliance for Lot #4. All affected products from 0700 hours to the retest at 0736 hours were retained and segregate in the cooler. I then performed a 03J02 procedure for the specific lot for all CCP's plus the preshipment review. The establishment has identified fecal material to be a hazard in its hazard analysis and controls the hazard with CCP#3B. Fecal material harbors microorganisms and possible pathogens and must be prevented from entering into the chill system. This is a failure to meet the critical limit for no visible fecal material may enter the chiller system in violation of regulation 9 CFR 381.65(e). The developing trend in noncompliance was discussed again in the weekly plant meeting with plant management on 06-03-2010. FSIS would expect the establishment to have procedures in place to prevent the reoccurrence of contaminated birds from entering the chill system. Continued to failure to comply with regulatory requirements could result in additional enforcement action described in 9 CFR part 500. Past Similar NRs - Previous Ineffective Plant Actions: See establishment response to this noncompliance. The previous preventive actions have either not been implemented or ineffective to prevent this recurrence of CCP#3B of the plants HACCP Plan. NR: 62-2010 dated 7/15/2010

Regulation:

381.65(e) Poultry carcasses contaminated with visible fecal material shall be prevented from entering the chilling tank.

417.2(c)(4) List the procedures, and the frequency with which those procedures will be performed, that will be used to monitor each of the critical control points to ensure compliance with the critical limits;
