Citation: At approximately 0730 hours, while performing an unscheduled review and observation component for the 01C02 procedure in the Shipping Department. I observed water running down from the top of Docks 3 and 7 at the entrance to the trailers. I immediately informed the shipping employees not to put product on the trucks at Docks 3 and 7. I informed (2nd Processing Superintendent) and (Shipping Supervisor) of my observation. After a review of the plant records for the Shipping Department, no deficiencies were document for leaks. A Maintenance Work Order Number 03036, dated 06/09/10, Department - Shipping- by Shipping Supervisor Description of work requested, "It rained must of the day today. All of the docks were leaking water. This is across contamination problem." The noncompliance found involved no direct product contamination. This is a failure to comply with 9 CFR 416.2 (b) (2) as well as 9 CFR 416.1. I discussed verbally with plant management on my concern with water dripping from the ceiling/overhead structures in the establishment and during the USDA/Plant Management weekly meetings. This document serves as a written notification that your failure to comply with regulatory requirement could result in additional enforcement action described in 9 CFR part 500. At approximately 1318 hours, while walking in the main hallway I observed water dripping from the ceiling approximately 5 feet from the side entrance to evisceration near plant employee locker 471. I immediately informed ((1st Processing Superintendent) of my observation. The water was dripping from ceiling approximately every twenty second. The noncompliance found involved no direct product contamination. This is a failure to comply with 9 CFR 416.2 (b) (2) as well as 9 CFR 416.1. I discussed verbally with plant management on my concern with water dripping from the ceiling/overhead structures in the establishment and during the USDA/Plant Management weekly meetings. This document serves as a written notification that your failure to comply with regulatory requirement could result in additional enforcement action described in 9 CFR part 500. Past Similar NRs - Previous Ineffective Plant Actions: No response to this noncompliance by establishment, Previous preventive measures were either ineffective or not properly implemented. Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(1) Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.
