Citation: At approximately 8:30 a.m. I was walking through cut-up and noticed 1 bin of ice that had black specks and so I condemned the bin of ice. Upon further investigation I noticed 4 bins of mixed parts( wings, drumsticks, and legs). Upon further investigation I noticed black specks on the plastic and on the ice. I notified (2nd Processing Manager), & (QC) of my findings and tagged 4 bins with tag# B39801585, B39801584, B38670050 and B39802052..Then walking through packing I noticed a combo bin that was one quarter filled with product and the plastic was torn which made it an unsanitary container. I notified ( Packing Supervisor) of my findings and tagged the combo bin with tag#B38670052. Establishment management has received oral and written notification concerning this noncompliance. The noncompliance involved direct product cross contamination. This document serves as a written notification that your failure to comply with regulatory requirement could result in additional enforcement action described in 9 CFR part 500.

Regulation:

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
