Citation: At approximately 1840 hours, after plant's pre-operational sanitation and prior to the start of operation, I observed the following noncompliance's while performing pre-op sanitation (01B02) procedure, the following was observed: In the Air Chill department, I observed condensation dripping from overhead catwalks, pipes and support beams onto multiple shackles in Air Chill Chamber 2. I rejected Chamber 2 for unsanitary condition with US Rejected Tag B39 801337. I informed (Sanitation Supervisor) of my observation. While continuing my inspection in the Cut-Up Department at approximately 2150 hours, the following noncompliance was observed: Condensation dripping from underneath the box track that cross over the breast conveyor belt. Condensation dripping from overhead pipes, dirty electric cords and support frames onto product contact surfaces (Shackles, Machine Cutters and Tables). I observed chicken fat particles various size on the product contact surfaces of the breast incline conveyor and breast transfer conveyor (Overhead Conveyor) too numerous to count from previous day's operation. I rejected the Cut-Up Department with US Rejected Tag B39 801346. I informed (Sanitation Manager) of my observation. A check of the plant SSOP form (Air Chill) shows no deficiencies for the above noncompliance. The area was released for inspection and sign by designation persons at 1840 hours. A check of the plant SSOP form (Cut-Up Department) shows no deficiencies for the above noncompliance. The area was released for inspection and sign by designation persons at 2145 hours. All of the noncompliance's found were direct product contact surfaces. This is a failure to comply with 9 CFR 416.2 (b) (4) (d), 9 CFR 416.4(a), as well as 9 CFR 416.13c. There was no product involved at this time. My concerns with the plant Pre-Op sanitation procedure and the implementation of the plant SSOP Plan was discussed with plant management on 10/14/2010. Establishment management has received oral and written notification concerning this noncompliance. This document serves as a written notification that your failure to comply with regulatory requirement could result in additional enforcement action described in 9 CFR part 500.


416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.

416.2(d) Ventilation. Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
