Violation: 416.13(c), 416.2(b), 416.4(a), 416.4(b)

Citation: On Thursday, 11/18/2010, at approximately 2033 hours, after plant's pre-operational sanitation and prior to the start of operation, I observed the following noncompliance's while performing pre-op sanitation (01B02) procedure, the following was observed: In the Leg Debone Department) the following was observed: Water dripping from the overhead entrance framework onto the product contact surface of the overhead transfer conveyor. I rejected the overhead transfer conveyor with US Rejected Tag B39 801362. The water was dripping from the inside surface of the upper framework. I observed grease buildup on the product contact surfaces on two finished product conveyors. I rejected the two finished product conveyors with US Rejected Tag B39 801340. I observed chicken fat particles various sizes on the inside/outside surfaces of the box track location at the batch scale too numerous to count. I rejected the box track for unsanitary condition. I informed (Sanitation Manager) and (Sanitation Supervisor) of my observation. A check of the plant SSOP's forms (Leg Debone) shows no deficiencies for the above noncompliance's. This area was released at 2030 hours for inspection. All noncompliance found were from previous day's operation. This developing trend of noncompliance and the ineffectiveness of the preventive measures were discussed with plant management again during the weekly meeting on 11/10.2010. Continued failure to comply with regulatory requirements could result in additional enforcement action described in 9 CFR part 500. Past Similar NRs - Previous Ineffective Plant Actions: See establishment response to this noncompliance. The previous preventative measures have been either not been implemented or ineffective to prevent this recurrence of the establishment SSOP Plan. NR: 95-2010 dated 11/10/2010

Regulation:

416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.

416.2(b)(1) Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
