Violation: 416.13(c), 416.4(d)

Citation: At approximately 0049 hours, while performing an unscheduled review and observation component for the 01C02 procedure in the Cut-Up department. I observed one plant employee moving a stainless steel tank of skinless chicken thighs from the thigh skinner machine while production lines was still running and the skinner machine was stopped. I then observed skinless thigh falling from the skinner belt on the floor and floor drain cover at the front end of the skinner machine approximately thirty to forty skinless chicken thighs. I observed another employee trying to control the product flow of the chicken thighs at the skinner machine, while the chicken thighs on the thigh transfer conveyor were transferring to the skinner machine belt. There were chicken thighs falling onto the skinner machine employee station and the other side of the skinner belt. I immediately took a regulatory control action by asking maintenance employee to stop production in the Cut-Up Department. I also observed chicken thighs falling on the floor at the chicken thighs transfer conveyor. There were four whole chicken carcasses on the floor at this location. I rejected the Cut-Up Department for unsanitary condition with US Rejected B39 801375. I informed (Cut-Up Supervisor) and (2nd Processing Manager) of my observation. All product involved with this noncompliance were condemned by the establishment. After sanitary conditions were restored and the process was under control, I relinquished my regulatory control action at approximately 0056 hours. After reviewing the plant's SSOP records and GMP Monitor's records there were no entries documented prior to my observation of the noncompliance. The Establishment SSOP Plan under Operational Sanitation, revisions effective 03-18-2008: Processing " [redacted] ". Establishment management has received oral and written notification concerning this noncompliance. The noncompliance's involved direct products cross contamination. This document serves as a written notification that your failure to comply with regulatory requirement could result in additional enforcement action described in 9 CFR part 500.

Regulation:

416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
