Citation: On Sunday, 12/26/2010, at approximately 2042 hours, after plant's pre-operational sanitation and prior to the start of operation, I observed the following noncompliance's , while performed a review and observation component for the 01C02 procedure in the Deboning Department; Chicken fat particles various sizes, chicken pieces various sizes on the leg skinner bottom framework, trim stations bottom framework, batch scale bottom framework, Gainco machine bottom framework and approximately ten employee stands at the Gainco. I observed chicken fat particles various sizes too numerous too count on the floor in the Leg Debone, Thigh Debone and Breast Debone areas. Chicken fat particles various sizes in between the squares and frameworks on approximately six to eight employees stand at Breast Deboning Lines [redacted] and [redacted] Chicken fat particles various sizes on the floor at Breast Deboning Line [redacted] 2, and 3 to numerous to count. Chicken fat particles various sizes on the floor underneath the product transfer box track too numerous to count. Chicken fat particles various sizes and chicken pieces various sizes inside the drains and on top covers of the drains too numerous to count. I rejected the Deboning Department with US Rejected B39 801383 for unsanitary condition. I informed (Night Shift Plant Manager) of my observation. Dr. (SVMO) observed the unsanitary condition of the Deboning Department. At approximately 2125 hours, after sanitary conditions were restored, I relinquished the control action on Thigh and Leg Debone areas. At approximately 2137 hours, after sanitary conditions were restored, I relinquished the control actions on the Breast Debones Lines [redacted] and [redacted] A check of the plant SSOP's and GMP forms, plant's Operational Sanitation record (Deboning) shows no documentation for the above noncompliances. A check of the plant SSOP's forms (Thigh & Leg Debone) (Breast Deboning Lines [redacted] and Breast Portioning) theses areas were released at 1930 hours for inspection. There were approximately two hundred chicken fat particles and one hundred pieces involved in this noncompliance. All noncompliance found were from previous day's operation. The previous day of production was 12/23/2010. This developing trend of noncompliance and the ineffectiveness of the preventive measures were discussed with plant management during the weekly meeting on 12/15/2010. This failure to comply with regulatory requirements could result in additional enforcement action described in 9 CFR part 500.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.2(b)(2) Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
