Citation: On Tuesday, 12/28/2010, at approximately 1850 hours, after plant's pre-operational sanitation and prior to the start of operation, I observed the following noncompliance's while performing pre-op sanitation (01B02) procedure, the following was observed: Air Chill Department), I observed beads of condensation various sizes on the overhead pipes, electric gray pipes, catwalks and ceiling over the product zone area in Chamber 1. At approximately 1936 hours, I re-inspected Chamber 1 for condensation and observed a white drip pan pipe underneath the air cooling system location in zone 5 dripping water from to different location; the pipe to pan connection and at the elbow connection over the product zone area. I rejected Chamber 1 with US Rejected Tag B39 801395. I informed (Sanitation Manager) of my observation. A check of the plant SSOP form (Air Chill) shows deficiencies for the above noncompliance. Reason failed - condensation in Chamber 1. Corrective Measure - dried. Rewashed - N/A Resanitized - N/A. Product contact area - No. This area was released at 1844 hours for inspection. This developing trend of noncompliance and the ineffectiveness of the preventive measures will be discussed with plant management during the weekly meeting on 12/08/2010. Continued failure to comply with regulatory requirements could result in additional enforcement action described in 9 CFR part 500.

Regulation:

416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.

416.15(a) Each official establishment shall take appropriate corrective action(s) when either the establishment or FSIS determines that the establishment’s Sanitation SOP’s or the procedures specified therein, or the implementation or maintenance of the Sanitation SOP’s, may have failed to prevent direct contamination or adulteration of product(s).

416.2(d) Ventilation. Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.

416.3(a) Equipment and utensils used for processing or otherwise handling edible product or ingredients must be of such material and construction to facilitate thorough cleaning and to ensure that their use will not cause the adulteration of product during processing, handling, or storage. Equipment and utensils must be maintained in sanitary condition so as not to adulterate product.
