Citation: On Wednesday, 01/26/2011, at approximately 2043 hours, after plant's pre-operational sanitation and prior to the start of operation, Dr. (SVMO) and I observed the following noncompliance's while performing pre-op sanitation (01B02) procedure, in the Leg and Thigh Debone Department: Chicken fat pieces and particles various sizes on the product contact surface of the Leg Incline Conveyor and two (2) drop chutes too numerous to count from previous day's operation. I rejected the Leg Incline Conveyor and two drop chutes with US Rejected Tag B39 801224. I informed (Sanitation Manager) of my observation. While continuing my inspection in the Cut-Up Department, at approximately 2150 hours, the following noncompliance's were observed; Chicken fat pieces and particles various size on the product contact surface's of the three (3) Breast conveyors ( top surfaces, inside guard rails and conveyor links) too numerous to count from previous day's operation. I rejected the three (3) Breast Conveyors with US Rejected Tag B39 801225. A check of the plant SSOP's form (Leg and Thigh Debone Department) show no deficiencies for the above noncompliance. The area was released at 2036 hours for inspection. A check of the plant SSOP's for (Cut-Up Department) shows deficiencies for the Breast Conveyors at Cut-Up Line [redacted] an [redacted] for overspray. Corrective Measure - Rewashed and Resanitized. This area was released at 2130 hours for inspection. All noncompliance found were from previous day's operation. This developing trend of noncompliance and the ineffectiveness of the preventive measures were discussed again with plant management during the weekly meeting on 01/05/2011. Continued failure to comply with regulatory requirements could result in additional enforcement action described in 9 CFR part 500. The establishment previous preventive measures have not been implemented or ineffective to prevent this recurrence of this noncompliance. NR: 5-2011 dated 1/20/2011


416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.

416.15(a) Each official establishment shall take appropriate corrective action(s) when either the establishment or FSIS determines that the establishment’s Sanitation SOP’s or the procedures specified therein, or the implementation or maintenance of the Sanitation SOP’s, may have failed to prevent direct contamination or adulteration of product(s).

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
