Citation: On Tuesday, 02/15/2011, at approximately 1835 hours, after plant's pre-operational sanitation and prior to the start of operation, I observed the following noncompliance's while performing pre-op sanitation (01B02) procedure, the following was observed: Air Chill Department), I observed beads of condensation various sizes on the overhead pipes, electric gray pipes, dirty catwalks and Evaporators over the product zone area in Chamber 1. I rejected Chamber 1 with US Rejected Tag B39 801222. I informed (Sanitation Supervisor) of my observation. At approximately 1847 hours, in the (Live Hang/Slaughter/Scalding/Picking Department) the following was observed: Thick brown residue buildup underneath of all four (4) transfer tracks, thick brown residue buildup underneath the support frames and drip pan in the unloader area from previous day's operation. I rejected the unloader area for unsanitary condition. I observed twelve (12) missing black fingers from the picker wheels inside the Hock Picker. I informed (Sanitation Manager) of my observation. While continuing my inspection in the Evisceration Department, at approximately 1913 hours, I observed beads of condensation various sizes underneath upper surface to the rehangers on the west evisceration line. The upper surface to the rehanger was very dirty and feathers various sizes too numerous to count from previous day's operation. I rejected the west rehanger for unsanitary condition. I informed (Sanitation Manager) of my observation. A check of the plant SSOP form (Air Chill) shows deficiencies for the above noncompliance. Reason failed - condensation in Chamber 1. Corrective Measure - Re-mop. Rewashed - N/A Resanitized - N/A. Product contact area - No. This area was released at 1830 hours for inspection. A check of the plant SSOP form (Live Receiving, Live Hang, Slaughter, Scalding and Picking) shows deficiencies for the above noncompliance. Reason Failed - Unloader Framework for overspray. Corrective Measure - Rewashed. This area was released at 1835 hours for inspection. A check of the plant SSOP form (Evisceration West) shows no deficiencies for the above noncompliance. This area was released at 1840 hours for inspection. This developing trend of noncompliance and the ineffectiveness of the preventive measures will be discussed with plant management during the weekly meeting on 02/09/2011. Continued failure to comply with regulatory requirements could result in additional enforcement action described in 9 CFR part 500. Past Similar NRs - Previous Ineffective Plant Actions: See establishment response to this noncompliance. The establishment previous preventive measures have not been implemented or ineffective to prevent this recurrence of this noncompliance. NR: 10-2011 dated 1/30/2011

Regulation:

416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.

416.3(a) Equipment and utensils used for processing or otherwise handling edible product or ingredients must be of such material and construction to facilitate thorough cleaning and to ensure that their use will not cause the adulteration of product during processing, handling, or storage. Equipment and utensils must be maintained in sanitary condition so as not to adulterate product.

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
