Violation: 381.76(b)

Citation: At approximately 2317 hours, while performing a 04C04 ISP Code procedure for Finished Product Standards (Processing Nonconformance) Test at the Pre-chill Station) on the East Evisceration Line, the test exceed the absolute limit of 30, the FPS for Processing Category on the test was not in the action mode. My test results subgroup total was 38, the processing nonconformance's were one extraneous material <, three oil glands - remnant, three oil glands -two whole glands, eight lungs - whole, one crop - partial, one crop - whole, one feathers and/or pinfeathers, four feathers -large. I immediately notified (Evisceration Supervisor) of the processing nonconformance. Dr (SVMO) was also informed of the processing nonconformance. Quality Assurance performed a retest for Finished Product Standard processing nonconformance's on the east evisceration line at 2328 hours for processing nonconformance's and failed the retest tolerance with a test results subgroup total was Quality Assurance performed two consecutive retests for Finished Product Standard processing nonconformance's on the east evisceration line at 2340 hours and 2347 hours for processing nonconformance's and both tests pass. Quality Assurance tags 3 carcasses with orange tags to mark the end of the failure mode. At approximately 2351 hours, 0020 hours, 0051 hours, 0120 hours, 0151 hours and 0220 hours Quality Assurance performed retests for processing nonconformance at the post chill station and all retest passed. At approximately 0243 hours, the orange tags came out of the chiller marking the end of the failure mode. This is a failure to comply with 9 CFR 381.76(b). Establishment management has received oral and written notification concerning this noncompliance. This document serves as a written notification that your failure to comply with regulatory requirement could result in additional enforcement action described in 9 CFR part 500.

Regulation:

381.76(b) Presentation: Each inspector shall be flanked by an establishment employee assigned to be the inspector’s helper. The one inspector on the SIS–1 line shall be presented every bird. Each inspector on the SIS–2 line shall be presented every other bird on the line. An establishment employee shall present each bird to the inspector properly eviscerated with the back side toward the inspector and the viscera uniformly trailing or leading. Each inspector shall inspect the inside, viscera, and outside of all birds presented.
