Violation: 416.13(c), 416.15(b), 416.4(a), 416.4(b)

Citation: On Sunday, March 6, 2011, at approximately 1948 hours, while performed an unscheduled review and observation component for the 01C02 procedure in the Evisceration Department, I observed chicken fat particles various sizes on the product contact surface of the East Line Rehang Conveyors too numerous to count. Chicken fat particles inside the drip pan to the East Rehang conveyor too numerous to count. I immediately took a regulatory control action on the East Line Rehang Conveyors with US Rejected Tag B39 801244. Further examination, at approximately 1951 hours, I observed chicken fat particles various sizes on the product contact surfaces of the West Line Rehang Conveyors too numerous to count. I also observed chicken fat particles various sizes inside of the links to the West Rehang Conveyors. I rejected the West Line Rehang Conveyors with US Rejected Tag B39 801243. I informed (Sanitation Manager) of my observation. No products involved at this time. After sanitary conditions were restored and the process was under control, I relinquished the regulatory actions on the East Rehang Conveyor at approximately 1958 hours and West Rehang Conveyor Belts at approximately 2002 hours. At approximately 2052 hours, while continuing my review and observation in the Deboning Department, I observed chicken fat particles various sizes on the product contact surface of the Gainco Product Conveyor too numerous to count. I also observed chicken fat particles inside the drip pan to the Gainco Product Conveyor. I immediately took a regulatory control action on the Gainco Product Conveyor with US Rejected Tag B39 801242. At approximately 2058 hours, I observed chicken fat particles on the product contact surface of the Rib Cage Conveyor and drip pan too numerous to count. I rejected the Rib Cage Conveyor with US Rejected Tag B39 801241. I informed (Night Shift Plant Manager) of my observation. After sanitary conditions were restored and the process was under control, I relinquished the regulatory action on the Gainco Product Conveyor at approximately 2102 hours and Rib Cage Conveyor at approximately 2128 hours. A check of the plant GMP forms and plant's Operational Sanitation record (Evisceration) shows no documentation for the above noncompliances. A check of the plant SSOP form for (West Evisceration) shows West Rehanger fails, reason failed - black greases, Corrective measures - rewashed and resanitized. This Department was released at 1830 hours for inspection. A check of the plant SSOP form for Breast Deboning Line and Breast Portioning) shows Rib Cage Conveyor fail, reason failed - overspray, Corrective measures - rewashed and resanitized. This Department was release at 1830 hours for inspection. The Establishment SSOP Plan under Operational Sanitation, revisions effective 03-18-2008: Processing " [redacted]. Establishment management has received oral and written notification concerning this noncompliance. The noncompliance's involved direct products cross contamination. This document serves as a written notification that your failure to comply with regulatory requirement could result in additional enforcement action described in 9 CFR part 500. .

Regulation:

416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.

416.15(b) Corrective actions include procedures to ensure appropriate disposition of product(s) that may be contaminated, restore sanitary conditions, and prevent the recurrence of direct contamination or adulteration of product( s), including appropriate reevaluation and modification of the Sanitation SOP’s and the procedures specified therein or appropriate improvements in the execution of the Sanitation SOP’s or the procedures specified therein.

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
