Citation: On Tuesday, 03/22/2011, at approximately 1835 hours, after plant's pre-operational sanitation and prior to the start of operation, I observed the following noncompliance's while performing pre-op sanitation (01B02) procedure, the following was observed: (Deboning Department), Chicken fat particles various sizes on the product contact surfaces of the overhead thigh transfer conveyor and overhead breast portion transfer conveyor from previous day's operation too numerous to count. I rejected the thigh and breast portion transfer conveyors with US Rejected Tag B39 801257. Chicken particles various sizes were also located inside the drip pans to the thigh and breast portion conveyors. Chicken fat pieces and particles various sizes on the product contact surface (employee product drop chutes, transfer conveyor and employee cutting boards) of the Gainco Machine from previous day's operation too numerous to count. I rejected the Gainco Machine with US Rejected Tag B39 801260. I observed beads of condensation various sizes dripping from the overhead support frames onto the product zone area in the stack-off area at the leg dumper. I rejected the Stack-Off area with US Rejected Tag B39 801259. I also observed approximately a 15x15 square open in the wall between tray pack dumper and rib cage crusher with brownish residue buildup and chicken fat particles various sizes underneath the bottom bent frame work. I informed (Sanitation Manager) and (Sanitation Supervisor) of my observation. While continuing my inspection the Cut-UP Department, at approximately 2245 hours, I observed chicken fat particles various sizes on the product contact surface of the overhead breast transfer conveyor from previous day's operation too numerous to count. I rejected the overhead breast transfer conveyor for unsanitary condition with US Rejected Tag B39 801258. I informed (Sanitation Manager) and (Sanitation Supervisor) of my observation. A check of the plant SSOP form (Thigh and Leg Debone) shows no deficiencies for the above noncompliance. This area was released at 2040 hours for inspection. A check of the plant SSOP form (Breast Lines and Breast Portioning) shows no deficiencies for the above noncompliance. This area was released at 2035 hours for inspection. A check of the plant SSOP form (Cut- Up) shows no deficiencies for the above noncompliance. This area was released for inspection at 2230 hours. This developing trend of noncompliance and the ineffectiveness of the preventive measures will be discussed again with plant management during the weekly meeting on 3/24/2011 Continued failure to comply with regulatory requirements could result in additional enforcement action described in 9 CFR part 500. Past Similar NRs - Previous Ineffective Plant Actions: See plant response to this noncompliance. The establishment previous preventive measures have not been implemented or ineffective to prevent this recurrence of this noncompliance. NR: 14-2011 dated 2/7/2011

Regulation:

416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.

416.2(b) Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions.

416.2(d) Ventilation. Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
