Citation: On Sunday, 3/27/2011, at approximately 2347 hours, while performing the 04B04 ISP procedure in the Tray Pack area, I observed eight forty pound boxes of product stacked on top of other product with no date on the products. Upon further examination, the three boxes of product contain no date and time. The label on the boxes of product read as following, "Organic Buffalo Wings with a time for Tray Pack" (hand written). I immediately retained the eight boxes of Organic Buffalo Wings with US Retained Tags B39 801270. While informing (2nd Processing Manager) of my observation, we observed boxes of Organic Buffalo Wings for Tray Pack with a time and no date (hand written) on the product going to the stack-off area in Cut-Up Department to be placed in the cooler. I immediately informed Quality Assurance retained the boxes with Organic Buffalo Wings for Tray Pack. All eight boxes of product retained were condemned by established. After a review of the plant records for the Shipping Department, shows no deficiencies were documented for under dated product. A review of the establishment's Weekly Production Schedule (03/21/11 to 03/25/11) shows four days the establishment slaughter Organic Chickens. I discussed verbally with plant management on my concern with product being properly identified in the stored cooler before or prior to shipping during the USDA/Plant Management weekly meetings. This document serves as a written notification that your failure to comply with regulatory requirement could result in additional enforcement action described in 9 CFR part 500.

Regulation:

381.129(c) A calendar date may be shown on labeling when declared in accordance with the provisions of this paragraph: (1) The calendar date shall express the month of the year and the day of the month for all products and also the year in the case of products hermetically sealed in metal or glass containers, dried or frozen products, or any other products that the Administrator finds should be labeled with the year because the distribution and marketing practices with respect to such products may cause a label without a year identification to be misleading.
