Citation: On Tuesday, 04/05/2011, at approximately 1851 hours, after plant's pre-operational sanitation and prior to the start of operation, I observed the following noncompliance's while performing an unscheduled pre-op sanitation (01B02) procedure in the Air Chill Department, Rust buildup on all four turning wheels to the four Mist Cabinets in Chamber 1 from previous day's operation. Three overhead lights not working in Chamber 3. This section of Chamber 3 is very dim without the overhead lighting. I informed (Sanitation Supervisor) of my observation. In the Evisceration Department, at approximately 1908 hours, water was leaking from an overhead white pipe at the East Gizzard Machine location and water was leaking from the ceiling at the East Gizzard Harvest Station Location. I informed (Sanitation Supervisor) of my observation. In the (Live Hang/Slaughter/Scalding/Picking Department), at approximately 1940 hours, the following was observed: Excessive amount of buildup with feathers, fecal materials, dirt water and debris inside of the SIA (Slow Induce Anesthesia) System. The buildups were on the top, bottom, and tracks throughout the tunnel. A strong foul odor coming from the SIA System I rejected the SIA System with US Rejected Tag B39 801271 for unsanitary condition. I informed (Sanitation Manager) of my observation. A check of the plant SSOP's forms ((Live Receiving/Live Hang/Slaughter/Scalding & Picking) shows no deficiencies for the above noncompliance. These areas were released at 1925 hours for inspection. A check of the plant SSOP's form Evisceration East Department shows no deficiencies for the above noncompliance. This area was release at 1855 hours for inspection. A check of the plant SSOP's for (Air Chill Department) show no deficiencies for the above noncompliance. This area was released at 1845 hours for inspection. All noncompliance found were from previous day's operation. This developing trend of noncompliance and the ineffectiveness of the preventive measures will be discuss again with plant management during the weekly meeting on 04/07/2011. Continued failure to comply with regulatory requirements could result in additional enforcement action described in 9 CFR part 500. Past Similar NRs - Previous Ineffective Plant Actions: No response from Establishment at this time. NR: 25-2011 dated 3/29/2011

Regulation:

416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.

416.2(b)(2) Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions.

416.2(c) Light. Lighting of good quality and sufficient intensity to ensure that sanitary conditions are maintained and that product is not adulterated must be provided in areas where food is processed, handled, stored, or examined; where equipment and utensils are cleaned; and in hand-washing areas, dressing and locker rooms, and toilets. 

416.2(e) Plumbing. Plumbing systems must be installed and maintained to: (2) Properly convey sewage and liquid disposable waste from the establishment;

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
