Citation: At approximately 2145 hrs., after the plants pre-operational sanitation and prior to the start of operations, I observed the following noncompliance's while performing the 01B02 procedure for pre-operational sanitation. In the cut-up department I observed chicken particles, overspray and blood clots on the upper back conveyor and metal plate belt guard. I immediately rejected the back conveyor with U.S. tag #B39801283 and notified the sanitation manager of the noncompliance. I also notified of condensation on the over head white pipe directly above the back conveyor. While continuing my inspection of the cut-up department at 2155 hrs., I observed pieces of fat and product residue under the whole leg conveyor and on the white plastic guide rails. I immediately rejected the whole leg conveyor with U.S. tag #B39133623 and notified the sanitation manager of the noncompliance. Both the back and the whole leg conveyors were direct product contact surfaces. After a review of the plants SSOP records for the cut-up department, the upper back conveyor was documented as acceptable, the whole leg conveyor was documented as rejected for (CP) chicken pieces, recleaned and sanitized and the department was released for USDA inspection at 2135 hrs. This document serves as a written notification that failure to comply with regulatory requirements could result in additional enforcement action described in 9 CFR part 500.

Regulation:

416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.

416.2(d) Ventilation. Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
