Citation: At approximately 1850 hrs. after the plants pre-operational sanitation and prior to the start of operations I observed the following noncompliance's. In the live/picking room department I observed an door leading to the outside open without a screen in place. Sanitation employees were outside smoking at the time and do not have a swipe card to re-enter the department. I immediately notified of this issue and reminded him this was brought up at a previous weekly meeting with the plant. Also while continuing my inspection in the deboning department I observed pieces of fat and chicken meat on the gainco product conveyor metal frame and the outside of the box track, both were nonproduct contact surfaces, time was approximately 2045 hrs. In the cut-up department I observed multiple pieces of fat and overspray on the stack off conveyor and area. Also I observed condensation on overhead gray pipes. The time of the observation was approximately 2200 hrs. I immediately notified of all noncompliance's of nonproduct contact surfaces. After a review of the plants SSOP records the deboning department was released at 2020 hrs. for USDA inspection and all units were documented as acceptable. The cut-up department was released for USDA inspection at 2150 hrs. and the units were documented as acceptable. This document serves as a written notification that failure to comply with regulatory requirements could result in additional enforcement action described in 9 CFR part 500.


416.2(d) Ventilation. Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
