Citation: At approximately 1150 hours, I inspected a chicken carcass that was held by an on- line food inspector for my examination. I found out that the carcass was a DOA. In the USDA/plant weekly meeting on August 4, 2011, the plant management was notified of frequent incidence of DOAs findings by the inspection program personnel on the evisceration lines after start of stunning by CO2. A DOA carcasse creates insanitary conditions & is to be condemned at Ante-mortem and disposed of per 9 CFR 381.95. A DOA is adulterated and is not to be brought into the production department per 9 CFR 381.71. Poultry that die otherwise than slaughter are adulterated under under 21 U.S. C. 453(g)(5) of the Poultry Products Inspection Act (PPIA) and under 21 U.S. C. 458(a)(1) of the PPIA it is a prohibited act to process any poultry products that are capable of use as human food except in compliance with the requirements of the law. Further the operation should be in accordance with the 9 CFR 416.4 (d) that requires protection of product from adulteration during all phases of processes. Your establishment is expected to remove DOA birds from the live birds before hanging the live birds on the live line thus preventing them from entering the slaughter operation.

Regulation:

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
