Citation: At approximately 0100 hours on 10/11/2011 production day, I performed a net weights verification test on Farmer's Pride leg quarters of variable weights, bulk- packed at approximately 40 pounds. The label stated the production day as Julian 284, which was the prior shift's production, and the label time was the 1600 hour. Of a 65-case lot, I tested 10 cases. Two of the ten cases failed to meet the Maximum Allowable Variation criteria (1%): one case labeled 41.45 pounds was underweight by 1.45 pounds at 40.00; the second was labeled 41.25 pounds and underweight by .85 pounds at 40.40. I tagged all 65 cases in the lot with US Retain tag No. B39800701, and informed Night Shift Second Processing Manager of the noncompliance. At approximately 0245 hours, I performed a retest of ten cases of the retained product, which was acceptable. I released the product back to production. Failure to comply with regulatory requirements could result in additional enforcement action as described in 9 CFR part 500.

Regulation:

381.121(b) When a poultry product and a nonpoultry product are separately wrapped and are placed in a single immediate container bearing the same name of both products, the net weight on such immediate container may be the total net weight of the products, or such immediate container may show the net weights of the poultry product and the nonpoultry product separately. Notwithstanding the other provisions of this paragraph, the label on consumer size retail packages of stuffed poultry and other stuffed poultry products must show the total net weight of the poultry product, and in close proximity thereto, a statement specifying the minimum weight of the poultry in the product.
