Citation: At approximately 0925 hours, Dr. entered the evisceration floor and noticed a black tub positioned at the end of the west rehang conveyor belt. This positioning is directly under the line and blood from the birds drips onto the area. Upon further investigation Dr. found three birds in the tub with numerous blood drops on them. There was also a significant amount of blood on the bottom of the tub, and on the sides and edges. There was no identification/hold tag on the tank, which should be applied when the first bird is placed in a tank, as per the establishment’s WIP un-eviscerated bird procedure. Dr. took regulatory control action by tagging the tub and the birds within with tag No. B39801805 at approx. 0930. She observed condemn the three birds and begin washing the tub, despite the regulatory control, which is in violation of the Rules of Practice, 9CFR part 500. Dr. notified (1st Processing Manager) of the noncompliance. In addition, the tub on the east side of rehang had a corner under the line and blood had dripped into that tub. Dr. removed her tag so that the west tub could be cleaned. She observed as and establishment personnel moved both tubs and cleaned them. At 0940 Dr. inspected both tubs and found them to be clean and sanitary conditions restored. informed Dr. that the assistant for that area had been moved to another area and would now be put back on. A check of the evis floor tanks by QA found tanks to be acceptable at 0908 hrs and during the previous hourly checks. The black tub program has been discussed in previous weekly meetings and with the evisceration floor staff. This failure is a violation of 416.13(c), 416.4(d), and the establishment’s SSOP procedures. This document serves as written notification that failure to comply with regulatory requirements could result in additional enforcement action described in 9CFR part 500.

Regulation:

416.13(c) Lighting of good quality and sufficient intensity to ensure that sanitary conditions are maintained and that product is not adulterated must be provided in areas where food is processed, handled, stored, or examined; where equipment and utensils are cleaned; and in hand-washing areas, dressing and locker rooms, and toilets.

416.4(d) Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.
