Citation: At approximately 0635 hours I, USDA, FSIS, Consumer Safety Inspector, performed scheduled Sanitation performance standards (SPS) “Facilities & Equipment” and detected the following noncompliance located in the evisceration department of establishment 01304 P/1:[newline][newline]1. One black product tank with un-eviscerated carcasses approximately 15 in total was being stored directly under the moving evisceration line. Blood was dripping directly onto the carcasses presenting a possible cross contamination situation and at the least an unsanitary condition.[newline][newline]Evisceration Department Supervisor, Ms. was informed of infraction and was also informed that a USDA retain tag was applied to the black product tank and contents. This non-compliance may inadvertently affect product. This is in violation with Meat & Poultry Inspection Regulations Cfr\9cfr416.3(a),416.4(a),(d) that were not met.[newline][newline]This is official written documentation of a SPS PRODUCT BASED noncompliance. USDA “RETAINED” tag #B39801943 was applied to black product container and aforementioned product at 0635 hours on 02/16/2012 and released at 0705 hours to Department Supervisor, Ms. only after equipment and affected product was reconditioned to show sanitary conditions were met. NR#YNB0014024009N dated 02/09/2012 reflects a related non-compliance in nature. NOTE: Failure to comply with Regulatory requirements may lead to additional Regulatory control actions and/or administrative action.


416.3(a) Equipment and utensils used for processing or otherwise handling edible product or ingredients must be of such material and construction to facilitate thorough cleaning and to ensure that their use will not cause the adulteration of product during processing, handling, or storage. Equipment and utensils must be maintained in sanitary condition so as not to adulterate product.

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
