USDA Inspection Report: 19 Mar 2012

Code: 06D02
Violation: 381.77

Citation: At approximately 1215 hours, while giving breaks on the west line, I instructed the trimmer/helper to hang a bird back on the red USDA shackle, which he did. The two red shackles on each stand are marked 'Removal by USDA only.' This bird was dark and had swollen viscera. A few minutes later I glanced at the shackle and saw that the bird was no longer there. I rang the bell and notified (Evisceration Lead). and (Evisceration Supervisor) spoke with their employees and were unable to locate the bird. informed me she would have the cameras checked to see who removed the bird. There have been multiple previous incidences of birds being removed from the USDA hang back rack, including an NR dated 2/23/12. Previous establishment actions have been ineffective in preventing reoccurrence. This noncompliance is a failure to comply with 9CFR 381.77. This document serves as written notification that further failure to comply with regulatory requirements may lead to additional administrative action.

Regulation:

381.77 Each carcass, including all parts thereof, in which there is any lesion of disease, or other condition which might render such carcass or any part thereof adulterated and with respect to which a final decision cannot be made on first examination by the inspector, shall be held for further examination. The identity of each such carcass, including all parts thereof, shall be maintained until a final examination has been completed.
