Citation: At approximately 0845 hours, an inspector notified me they had hung a bird on the red USDA shackle and it was no longer there. The two red shackles on each stand are marked 'Removal by USDA only.' This bird had signs of sepsis and a brown discolored heart. The inspector was able to confirm that the bird was hung on the USDA shackle.[newline]I notified (Evisceration Supervisor) and (1st Processing Manager), who were already aware of the situation.  had spoken with the establishment's employees and was unable to locate the bird.   informed me that an employee had picked up a bird from the floor by the stand, and it may have been the bird from the USDA stand. The bird which was picked up was condemned and it could not be deterimined if this was the same bird. [newline]There have been multiple previous incidences of birds being removed from the USDA hang back rack, including an NR dated 3/19/12. Previous establishment actions have been ineffective in preventing reoccurrence. This noncompliance is a failure to comply with 9CFR 381.77. This document serves as written notification that further failure to comply with regulatory requirements may lead to additional administrative action.


381.77 Each carcass, including all parts thereof, in which there is any lesion of disease, or other condition which might render such carcass or any part thereof adulterated and with respect to which a final decision cannot be made on first examination by the inspector, shall be held for further examination. The identity of each such carcass, including all parts thereof, shall be maintained until a final examination has been completed.
