Citation: At approximately 2220 hrs. after the plants pre-operational inspection and prior to the start of operations, I observed the following noncompliance while performing the review and observation procedure in the cut-up department. In the area located at the double doors leading out to the shipping dock I observed green and gray crates stacked off on the cvp machine roller track. None of the crates were placed on the metal skids or wrapped with shrink wrap, and labeled, to indicate they were washed and released from the tote wash room per plant procedure. I questioned the sanitation supervisor about why the crates were stored in this area and he said the sanitation crew cleans these crates for the cut-up department. I then proceeded to inspect some of the green and gray crates and observed chicken meat, pieces of fat and numerous chicken particles in multiple crates I inspected. I immediately rejected all the green and gray crates (approximately one skid), with U.S. tag #B40170488 and notified of the noncompliance. After a review of the plants SSOP records, the crates were documented as acceptable by sanitation and released at 2010 hrs. This document serves as a written notification that failure to comply with regulatory requirements could result in additional enforcement action described in 9 CFR part 500.

Regulation:

416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.

416.4(a) All food-contact surfaces, including food-contact surfaces of utensils and equipment, must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
