Citation: At approximately 0815 hrs, I walked into the tray pack department and observed the following noncompliance: I observed a large cardboard combo bin with blue plastic liner inside setting on top of the cryovac machine (whole birds). I also observed 2 large cardboard combo bins with blue plastic liners one inside the other (nesting). I looked for a supervisor and not finding one, I went to the offices. I talked with who paged I returned to the cryovac line and applied 2 reject tags; Reject tag Number B39800709 to the nesting combos and B39800708 to the large combo bin on top of cryovac machine. supervisor for the department came in. A Farmer’s Pride associate explained to her that the combos were left over from nightshift I explained about the noncompliance to her. had Ms. get a bottle of sanitizer. The combo on top of the machine was removed. The machine was rinsed and sanitizer was applied. The combo that was nesting in the combo was removed the blue plastic was removed while I watched. The reject tags were removed. The area was released. [newline]This noncompliance is a failure to comply with 9CFR 416.3(a). This document serves as written notification that futher failure to comply with regulatory requirements may lead to additional administrative action.          

Regulation:

416.3(a) Equipment and utensils used for processing or otherwise handling edible product or ingredients must be of such material and construction to facilitate thorough cleaning and to ensure that their use will not cause the adulteration of product during processing, handling, or storage. Equipment and utensils must be maintained in sanitary condition so as not to adulterate product.
