Citation: On this day while performing a scheduled PBIS verification procedure 06D01, non-compliance was observed. Facilities compliance in the RTE production room was reviewed with the following findings of note; on the north wall the large double door has wood framing around the inside edge of the door, this wood has several holes from removed screws as well as unpainted surface area. Also on the inner edge of this frame around the doors is an unpainted 1 inch strip of cinder block wall, as well as a crack between the aforementioned wood frame and unpainted cinder block edge. On the north wall; the small exit door has a rusted and deteriorating door frame at the bottom right edge, with a hole approximately 1/4 inch by 1/2 inch through which outside sunlight can be seen radiating into the RTE production room. On the west wall near the top of the ceiling, two smaller pipes of approximately 1 inch in diameter go through a hole in the wall which is approximately 5 inches in diameter. No material can be seen sealing the extra gap around the two pipes to eliminate the extra gap. It is noted that this extra gap does not lead outside of the production facility but is still of concern since it leads into a maintenance room which may pose possible hazards if air flows from the maintenance area into the RTE production room. Observations by inspection represent a failure of the establishment to maintain their facility according to Regulations specifically 9 CFR 416.2(b)(1) which states "Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.", 9 CFR 416.2(b)(2) which states "Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions.", and 9 CFR 416.2(b)(3) which states "Walls, floors, ceilings, doors, windows, and other outside openings must be constructed and maintained to prevent the entrance of vermin, such as flies, rats, and mice." was informed of this non-compliance with regulations both verbally and in writing with the issuance of this Non-compliance Report.

Regulation:

416.2(b)(1) Establishment buildings, including their structures, rooms, and compartments must be of sound construction, be kept in good repair, and be of sufficient size to allow for processing, handling, and storage of product in a manner that does not result in product adulteration or the creation of insanitary conditions.

416.2(b)(2) Walls, floors, and ceilings within establishments must be built of durable materials impervious to moisture and be cleaned and sanitized as necessary to prevent adulteration of product or the creation of insanitary conditions.

416.2(b)(3) Walls, floors, ceilings, doors, windows, and other outside openings must be constructed and maintained to prevent the entrance of vermin, such as flies, rats, and mice.
