Violation: 417.3(c), 417.4(a)(2)(ii), 417.5(a)(3)

Citation: While performing a review of establishment corrective action records, non-compliance was observed. Establishment production sheet "JTS-HACCP-Form-011" for cooking and chilling of turkey BBQ product for lot X15100P with a cook run dated 6-15-2011 indicates a CCP result of [redacted] Deg.F for [redacted] second hold. The establishment's critical limit for this CCP is [redacted] Deg.F for [redacted] second hold. The establishment's production sheet indicates that product was placed back in the cooker as the CCP was not met. Establishment's pre-shipment review record dated 6-16-2011 for lot X15100 indicates there was a critical limit deviation and that corrective actions were taken and completed. This preshipment form also has a note stating "upon packaging 1st container--CCP1B was not met. Product placed back in cooker and all subsequent CCP1B's were met." Establishment's HACCP Plan states that [redacted]. When asked if any further documentation concerning corrective actions taken in regards to the above production date, management stated they did not believe there to be any other records. Although the establishment monitor identified the deviation, placed product back in the cooker and increased cooking time/heat, and all subsequent critical limits were achieved or exceeded, the establishment failed to properly document their corrective actions as per their HACCP Plan. This is a violation of; 9 CFR 417.3(c) which states "All corrective actions taken in accordance with this section shall be documented in records that are subject to verification in accordance with 9 CFR 417.4(a)(2)(iii) and the recordkeeping requirements of 417.5 of this part.", 9 CFR 417.4(a)(2)(ii) which states "Ongoing verification activities. Ongoing verification activities include, but are not limited to: Direct observations of monitoring activities and corrective actions;", and 9 CFR 417.5(a)(3) which states "The establishment shall maintain the following records documenting the establishment's HACCP plan: Records documenting the monitoring of CCP's and their critical limits, including the recording of actual times, temperatures, or other quantifiable values, as prescribed in the establishment's HACCP plan; the calibration of process-monitoring instruments; corrective actions, including all actions taken in response to a deviation; verification procedures and results; product code(s), product name or identity, or slaughter production lot. Each of these records shall include the date the record was made." was informed of this non-compliance with regulations verbally and was informed in writing with the issuance of this Non-compliance Report.

Regulation:

417.3(c) All corrective actions taken in accordance with this section shall be documented in records that are subject to verification in accordance with 417.4(a)(2)(iii) and the recordkeeping requirements of 417.5 of this part.

417.4(a)(2)(ii) Direct observations of monitoring activities and corrective actions

417.5(a)(3) Records documenting the monitoring of CCP’s and their critical limits, including the recording of actual times, temperatures, or other quantifiable values, as prescribed in the establishment’s HACCP plan; the calibration of process-monitoring instruments; corrective actions, including all actions taken in response to a deviation; verification procedures and results; product code(s), product name or identity, or slaughter production lot. Each of these records shall include the date the record was made.
