Violation: 417.3(c), 417.5(a)(3), 417.5(b)

Citation: On this day Inspection performed a required 03J02 procedure as a follow up to 03J01 non-compliance #015-2011 which was issued for CCP1B fecal failure as observed by Inspection. Establishment's HACCP Plan signed and dated 9-15-2011 by for CCP1B indicates "[redacted]. Upon review of establishment pre-shipment review, establishment form ", it was observed that the reviewer checked boxes indicating all Critical Limits were met for the day, and no corrective actions were taken. In fact, there was a critical limit deviation as documented by Inspection, and plant management was advised to begin corrective actions by Inspection immediately following the observation of the fecal contamination. After further investigation, the following was revealed; corrective actions were implemented but no records were documented at the time regarding the actions taken, or the results verification procedures performed. Observation by Inspection represents a failure of the establishment to follow their own written HACCP Program regarding corrective actions, a failure to document corrective actions and results of verification procedures involved with corrective actions, failure to maintain HACCP records as required, and a failure of the pre-shipment system in place to find and prevent the issues described above. This is a violation of 9 CFR 417.3(c) which states "All corrective actions taken in accordance with this section shall be documented in records that are subject to verification in accordance with 9 CFR 417.4(a)(2)(iii) and the recordkeeping requirements of 9 CFR 417.5 of this part.", 9 CFR 417.5(a)(3) which states "The establishment shall maintain the following records documenting the establishment's HACCP plan: Records documenting the monitoring of CCP's and their critical limits, including the recording of actual times, temperatures, or other quantifiable values, as prescribed in the establishment's HACCP plan; the calibration of process-monitoring instruments; corrective actions, including all actions taken in response to a deviation; verification procedures and results; product code(s), product name or identity, or slaughter production lot. Each of these records shall include the date the record was made.", and 9 CFR 417.5(b) which states "Each entry on a record maintained under the HACCP plan shall be made at the time the specific event occurs and include the date and time recorded, and shall be signed or initialed by the establishment employee making the entry." and were informed of this non-compliance with regulations verbally and was informed in writing with the issuance of this Non-compliance Report. Past Similar NRs - Previous Ineffective Plant Actions: establishment has not yet responded in writing to this non-compliance NR: 12-2011 dated 8/22/2011

Regulation:

417.3(c) All corrective actions taken in accordance with this section shall be documented in records that are subject to verification in accordance with 417.4(a)(2)(iii) and the recordkeeping requirements of 417.5 of this part.

417.5(a)(3) Records documenting the monitoring of CCP’s and their critical limits, including the recording of actual times, temperatures, or other quantifiable values, as prescribed in the establishment’s HACCP plan; the calibration of process-monitoring instruments; corrective actions, including all actions taken in response to a deviation; verification procedures and results; product code(s), product name or identity, or slaughter production lot. Each of these records shall include the date the record was made.

417.5(b) Each entry on a record maintained under the HACCP plan shall be made at the time the specific event occurs and include the date and time recorded, and shall be signed or initialed by the establishment employee making the entry.
