Citation: On this day while performing a scheduled pre-operational verification procedure, non-compliance was observed concerning establishment facilities. Inspection checked the establishment's Controlled Atmosphere Stunning (CAS) apparatus for general sanitation. This device has two large panels which are designed to enclose the body of the establishment's truck, resulting in a gas stun of all birds on the truck. Upon shining a light into the gas release vents, a residue buildup of brown material could easily be seen, the residue was spread throughout the inner panel of the gas releasing panels. Establishment personnel opened relief valves on the bottom of the panels, at which time thick black debris as well as liquid was released, also a foul odor was immediately noticed by all persons present. US Reject Tag #B24107324 was affixed to the area until the establishment could restore sanitary conditions. Observation by Inspection represents a failure to maintain sanitary conditions in their establishment, and is a violation of 9 CFR 416.1 which states "Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.", and 9 CFR 416.4(b) which states "Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product." was informed of this non-compliance with regulations verbally and was informed in writing with the issuance of this Non-compliance Report.

Regulation:

416.1 Each official establishment must be operated and maintained in a manner sufficient to prevent the creation of insanitary conditions and to ensure that product is not adulterated.

416.4(b) Non-food-contact surfaces of facilities, equipment, and utensils used in the operation of the establishment must be cleaned and sanitized as frequently as necessary to prevent the creation of insanitary conditions and the adulteration of product.
