Citation: At 0520 hours, I entered the Tray pack department and observed that the department was set up for operation and that product had been placed on the packing lines and the lids were removed from the totes. At that point I observed condensation dripping from one of the overhead pipes and into an open tote of product. At this point I took regulatory control of the product by applying U.S. Retain tag #B39801555 and I notified Mr. (QA Manager) and Mr. (SCSI) of the noncompliance and informed Mr. that a NR would be issued for this noncompliance. Establishment management have received oral and written notification concerning this noncompliance. Condensation was last discussed in the weekly meeting on 07/14/2010. Past Similar NRs- Previous Ineffective Plant Actions: The establishment previous measures were either not implemented or were ineffective in preventing the recurrence of this noncompliance. Continued failure to meet regulatory requirements could result in additional enforcement action as described in 9 CFR 500.


416.13(c) Each official establishment shall monitor daily the implementation of the procedures in the Sanitation SOP’s.

416.2(d) Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
