Citation: At approximately 0555 hours, I entered the whole bird cooler and observed that the plastic which had been hung in the area on 08/26/2010 was still in place and had not been changed. I took regulatory control of the whole bird cooler and applied U.S. Reject tags # B39801765, B39801582 and B39801560, to the entrances to the Whole bird cooler Mr. SCSI and I notified Mr. (First Processing Manager) and Mr. (Plant Manger) of the noncompliance and that an NR would be issued for this noncompliance. Establishment management have received oral and written notification concerning this noncompliance. Past Similar NRs- Previous measures were either not implemented or were ineffective in preventing the recurrence of this noncompliance. NR 0084-2010-17446 dated 07/29/2010. Failure to meet regulatory requirements could result in additional enforce actions as described in 9 CFR 500.


416.2(d) Ventilation adequate to control odors, vapors, and condensation to the extent necessary to prevent adulteration of product and the creation of insanitary conditions must be provided.

416.4(d) Product must be protected from adulteration during processing, handling, storage, loading, and unloading at and during transportation from official establishments.
